Chapter 7: Many individuals and businesses can qualify for chapter 7, sometimes called straight bankruptcy. An attorney should assess your financial situation and determine if you can discharge all of your debts and retain your assets. Certain debts are non-dischargeable and include student loans, spousal and child support, certain taxes and fines and debt for injuries incurred while operation of a motor vehicle.
Chapter 13: Chapter 13 is appropriate for individuals or families who are facing foreclosure of their home or whose gross income is in excess of the “means test” in their district. Chapter 13 allows them to formulate a plan to repay their debt over 3 to 5 years, repaying mortgage arrears or tax debt that is non-dischargeable.
Debt Settlement: Many individuals and businesses face certain debts that can be settled and resolved outside of bankruptcy court. An attorney can assist by representation in court in the defense of certain collection actions. Settlements and payment plans can be made with those creditors.
Stop Foreclosure: Foreclosure defense, including loan modification, is used to restructure the home loan, to avoid foreclosure. We use foreclosure defense and mediation together with loan modification to restructure the loan, to lower the interest rate, and payment amount. The back payments due are generally put on the back end of the loan. The homeowner can begin to make payments to the lender and have a fresh start to keep their home.
